Policy Statement for Restitution Payments

General Policy Statement

It is the policy of the Board of Judicial Policy and Administration that restitution payments totaling $25.00 or more shall be promptly distributed to third parties. Funds in excess of $25.00 will not be held.

Application of the Policy

This policy applies to district courts, circuit courts, and justice of the peace courts.

Specific Guidelines for Making Third Party Restitution Payments

Restitution payments received by a court shall be forwarded to the third party whenever the court has received funds totaling $25.00 or more. Nothing in this policy shall be construed as to limit any number of additional payments the clerks may choose to make.

Restitution payments received by a court shall be forwarded to the third party within 10 days of receipt of such funds.
